Terms of Service

You must be at least 18 years old and able to form a binding contract to use the Service. If you use Sepaso on behalf of a restaurant or business, you represent that you are authorized to bind that business to these Terms.

You are responsible for your account credentials and for all activity under your account. Keep your login secure and notify us promptly at support@sepaso.app if you suspect unauthorized access.

Sepaso helps restaurants create AI-generated food and drink photography from recipe details, organize menus, build printable flyers, and publish a shareable public menu with a QR code. Features, limits, and models may change, improve, or be discontinued over time.

“Your Content” means the information and materials you provide, including restaurant details, menu items, descriptions, prices, and any photos you upload. You retain ownership of Your Content.

You grant Sepaso a worldwide, non-exclusive license to host, store, reproduce, adapt, and display Your Content solely to operate and improve the Service — including generating images from it, rendering your public menu and flyers, and processing it through the third-party providers described in our Privacy Policy.

You represent that you own or have the necessary rights to all content you upload, and that it does not infringe anyone’s rights or violate any law.

Images are produced by third-party AI models (which currently may include OpenAI, Google, Anthropic, and Stability AI). Subject to your compliance with these Terms and the applicable provider terms, you may use the images you generate for your restaurant’s menus and marketing.

• AI output is generated automatically and may contain inaccuracies. You are responsible for reviewing every image before publishing or printing it.
• AI images are illustrative. They may not exactly depict portion size, ingredients, or plating. Do not present them in a way that misleads customers.
• Similar prompts can produce similar images for different users; we do not guarantee that any image is unique.
• You must not use the Service to generate content that is illegal, infringing, deceptive, or that violates a provider’s usage policies.

You agree not to:

• Upload content you do not have the rights to, or that is unlawful, infringing, hateful, or obscene;
• Misrepresent food, pricing, availability, or allergen information on your public menu;
• Attempt to bypass usage limits, rate limits, or security measures, or access the Service through automated means except our provided APIs;
• Reverse engineer, resell, or provide the Service to third parties except as intended by the product (e.g., publishing your own public menus);
• Use the Service to build a competing dataset or model, or to harm, overload, or disrupt the Service.

Sepaso offers a free tier and paid subscription plans. Each plan includes a monthly allotment of AI image generations and a limit on the number of restaurants. When you reach your plan’s image limit, generation is paused until you upgrade or your allotment resets.

Paid plans (where offered) are billed in advance on a recurring basis through our payment processor. Prices, features, and limits may change; we will give notice of material changes. Except where required by law, fees are non-refundable. You can stop future charges by cancelling before your next billing date.

When you publish a menu, its contents become publicly accessible to anyone with the link or QR code. You are solely responsible for the accuracy of your published menu, including prices, descriptions, and allergen or dietary information. Your public menu may collect anonymous engagement such as views and likes, and optional visitor activity, as described in the Privacy Policy.

The Service — including its software, design, templates, and branding — is owned by Sepaso and protected by intellectual property laws. These Terms grant you a limited, revocable, non-transferable right to use the Service; they do not transfer any ownership of the Service to you.

The Service relies on third parties for hosting, storage, authentication, AI processing, and payments. Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions. See the Privacy Policy for the current list.

You may stop using the Service and delete your account at any time from your settings. We may suspend or terminate your access if you breach these Terms, misuse the Service, or create risk or legal exposure. On termination, your right to use the Service ends; sections that by their nature should survive (e.g., content license for already-published material, disclaimers, limitations of liability) will survive.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, quality, or realism of AI-generated content. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Sepaso will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD $100.

You agree to indemnify and hold Sepaso harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
